  • Will of Eleanor Dyson of Spetchley August 1772

    In the name of God Amen, I Eleanor Dyson, late of Spetchley in the County of Worcester, but now of Birmingham, in the County of Warwick, widow, being of sound and disposing mind, memory and understanding, do for settling my wordly estate make this my last will and testament, in manner following, that is to say First, I will and direct that all my just debts, funeral expenses, and charges of proving and executing this my last will and testament, to be fully paid and satisfied. Also I give and bequeath to my wordly friends Thomas Westley of Birmingham aforesaid, plumber and glazier, and John Townsend of Cradley, saythesmith, all my leasehold messuage, tenements or dwelling houses situated in Digbeth, Birmingham, and commonly called the Holly Bush, now in the tenure of Paul Field, and also the other two properties being in a yard behind the Holly Bush and also the Bran houses, shops, buildings and premises. The tenure of all properties to remain with sitting tenants, each to pay a yearly sum of £7. This to be payable to Sir Thomas Gooch, Baronet, upon trust that they, the said Thomas Westley and John Townsend, and the survivor of them, and the executors and administrators of such survivors do and shall, from time to time, receive the rents, issues and profits of the said premises, and pay them to my sister, Martha Cox, widow, and Sarah Palmer, widow, for, and during the term of their natural lives, in equal shares and proportions, and to the survivors of them.

    Then I do give and bequeath the said three messuages and premises, unto the said John Townsend and Richard Townsend, their executors, administrators and assigns equally between them, to and for their respective proper uses, subject, nevertheless, to the payment of £15 a piece of each and every of the children of Thomas Marston, of Northfield, in the aforesaid County of Worcester, by his first wife, and I di hereby charge the said premises with the payment of the same £15 accordingly.

    Also I give and bequeath unto my said worthy friends and trustees Thomas Westley and John Townsend all those five other premises, tenements and dwelling houses also situate, standing and being in Digbeth, aforesaid, with the shops and outbuildings to the same, belonging, and now in the respective occupations of Jeffries, Warren, Saunders, Reynolds, Lea.

    Find also all and singular, other, the residue of my monies personal estate and effects whatsoever and wheresoever, upon trust, that they, the said Thomas Westley and John Townsend, and the survivors of them, and the executors  and administrators of such survivors, do, and shall, with all convenient speed, after my decease, sell and dispose of the same, for the most monies that can be had, and from and out of the Eleanor Southon, the sum of £20, and after payment of the same, then do, and shall pay, distribute and divide the remainder of the said monies unto and between my two nephews, Jacob Townsend, Clerk, and James Palmer of Spetchley, Worcester, and my two nieces Rebecca Westley, wife of Thomas Westley, and Penelope Williams, daughter of my sister.

    Equally between them, share and share alike, provided my said trustees, or either of them, shall not be answerable for any loss or diminishing which may happen to any part of my said estate or effects, which shall come nor shall the one be answerable for the act, deed, or default of the other. And lastly I do hereby nominate constitute and appoint the said Thomas Westley and John Townsend, Trustees and Executors of this my will, hereby  revoking all former wills, made by me. In witness whereof, I have set my hand and seal  in manner following. That is to say, to the first of them and any hand and to the last of them my hand and seal this 9th March 1772.
